Samba Group LLC ("the Company") operates a neutral professional services marketplace ("the Platform") connecting independent service professionals ("Providers") with customers ("Customers"). The Platform is not an employer, contractor sponsor, or immigration status verification authority, and facilitates lawful commerce only.
The Platform collects only the minimum data required to operate marketplace services and enforce compliance. The Company does not sell, resell, lease, monetize, or commercially transfer user data. Identifiable data is never distributed except when legally compelled by valid subpoena, law enforcement request, or regulatory inquiry. The Company may log marketplace activity, risk signals, payouts, listing actions, compliance holds, referral transactions, and moderation decisions for audit readiness, risk analysis, and Platform safety governance. Data is never shared for representative immigration enforcement targeting, and all transmissions are limited to what is legally required.
The Platform has no obligation, ability, or requirement to determine, validate, or monitor immigration or citizenship status. A user's immigration status has no bearing on the ability to buy or sell otherwise lawful professional or trade services.
The Platform may be used only for lawful professional or trade services, including but not limited to: handyman work, TV installation, mounting, electrical work, plumbing, HVAC, cleaning, home installation, IT support, appliance installation, furniture assembly, network cabling, general labor, and other commercial trade work where compliant with state, local, and federal law unrelated to immigration status.
The Platform may not be used for criminal or illicit activity, including but not limited to: identity or document fraud, human trafficking, forced labor, transportation of persons to evade law enforcement, smuggling, financial fraud, sanctions evasion, terrorism, malware distribution, money laundering, exploitation, extortion, or operating underground criminal service networks.
For service categories requiring licensing, Providers must upload valid credentials to receive "Licensed Provider" status. The Company may restrict, block, prevent, or re-label unlicensed Providers from offering regulated services in jurisdictions where licensing is mandatory. Unlicensed Providers may offer non-regulated services only under "Unverified Provider" status, which is not an endorsement, guarantee, sponsorship, or certification of service outcome.
Customers and Providers may transact on-Platform or off-Platform, including via cash, check, PayPal, or other third-party payment systems. The Platform does not mediate, guarantee, insure, or resolve off-Platform payment disputes. Providers receiving on-Platform payouts consent to: identity verification, sanctions screening, AML monitoring, payout throttling, payout frequency limits, duplicate account detection (email/phone/IP), and transaction logging. The Platform may suspend, hold, throttle, delay, reverse, or permanently restrict payouts at its sole discretion when compliance or elevated risk signals trigger.
The Company may deploy automated systems including: bot detection, VPN/IP risk scoring, duplicate email/phone/IP detection, payout velocity throttles, referral abuse monitoring, sanctions and AML screening, listing moderation, and enforcement logging. Duplicate or fraudulent accounts, coordinated abuse, or suspicious activity may be restricted or removed without notice.
Referral participation may require minimum account age, activity verification, daily caps, and fraud/dupe screening. Rewards are issued for legitimate business growth incentives only, and may be revoked if abuse, duplication, VPN masking, or fraudulent coordination is detected.
The Platform does not guarantee quality, safety, legality, performance, or service outcomes of any Provider service, even if verification badges are present. Badges verify uploaded credentials only and are not endorsements or guarantees. Providers alone assume responsibility for workmanship, wage compliance, insurance, licensing, safety, and jobsite conditions.
If a Customer reports unsafe conditions, or a Provider reports exploitation or abuse, the Company may suspend matches, restrict listings, block payouts, or remove accounts. The Company assumes no liability for physical jobsite conditions or third-party conduct.
The Company is not a party to disputes between Customers and Providers. Any claim against the Company is subject to binding individual arbitration in the United States. Class action or coordinated litigation is waived. Users agree that the Platform is not liable for off-Platform behavior, Provider service execution, or Customer payment defaults.
The Company may remove, suspend, delist, or restrict any user, listing, or account for any reason or no reason, at any time, without prior notice. Enforcement actions are logged for internal compliance records and may not be reversed.
The Platform is provided "as is" without warranty of any kind. The Company is not liable for losses, indirect damages, income disruption, or data exposure beyond what is legally required. Total liability of the Company to any user shall not exceed $100 USD.
This agreement is governed by United States federal law and, where applicable, the laws of the State of Delaware. All disputes shall be resolved in Delaware courts or through binding arbitration as elected by the Company.
The Company does not partner with, contract for, or cooperate with immigration enforcement except when legally compelled through valid judicial process. Immigration status is not a factor in marketplace access for otherwise lawful services.
The Company reserves the right to modify these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
